7.1. Access to the service
7.1.1.The service access is allowed to any member who possesses or creates an account.
7.1.2 In order to acces the service, the member has to accept the present document
7.1.3 CLISHOUSE LLC takes the right to limit the client's acces to the service or to erase his account if it considers that his behaviour can cause prejudices to CLISHOUSE or HISPANITAS brand.
7.1.4 Each member may have only one account. It is forbidden to share an account among many members or customers.
7.1.5. If CLISHOUSE discovers outbursts of this kind, the customer's access might be cancelled.
7.2 Products and Services
7.2.1 CLISHOUSE LLC may publish informations about products, services or promotions wich are practiced by it or by any other third part with whom CLISHOUSE LLC has signed partnership agreements in a certain period.
7.2.2. Products and / or services purchased through the service are intended solely for Customer's personal.
7.2.3. SC CLISHOUSE LLC may limit the ability of acquiring the goods or services available on site at a time to one or more clients.
7.2.4. All prices for products or services on the site are in LEI( Romania currency) and include TVA
7.2.5. Billing purchased products are made exclusively in USD. If payment is made by credit card, SC CLISHOUSE LLC will debit the Customer's current account with the amount representing the value of products ordered, then the latter transmission order confirmation.
7.2.6. If online payment SC CLISHOUSE LLC is not / can not be held responsible for any other additional cost to the customer, including but not limited to currency conversion charges applied by your bank thereof, where the currency issue its different RON. The responsibility for this action wears only client.
7.2.7. All information used to describe the products and / or services available on site (still images / dynamic / multimedia presentation / etc) is not a contractual obligation of the CLISHOUSE LLC, which are only for presentation purpose.
7.2.8. In describing the products and / or services SC CLISHOUSE LLC takes the right to use other products (accessories / etc) that may not be included in product costs
7.3. Online order
7.3.1. Customer may place orders for products marketed at a time, exclusively on the site.
7.3.2. By completing the order , the customer agrees that all data provided by them, necessary for the purchase, correct, complete and true to the time order is placed, called in this document "command issued".
7.3.3. By completing the order Customer consents to CLISHOUSE LLC- TEAM HISPANITAS can contact him by any means available / approved by CLISHOUSE LLC, in any situation where it is necessary to contact the Customer.
7.3.4. CLISHOUSE LLC may unilaterally terminate the order made by the Client, after prior notification to the customer without any further obligation to any part against the other or neither party has to ask for damages in these cases:

7.3.4.1. non-acceptance by the issuing bank Client transaction in case of online payment;

7.3.4.2. invalidation of the transaction by the card processor approved by CLISHOUSE LLC of online payment;

7.3.4.3. data provided by the Customer, the site is incomplete or incorrect;

7.3.4.4. Client's activity on site can cause damages of any nature to CLISHOUSE LLC and / or its partners

7.3.4.5 achieve more than two consecutive deliveries, failed

7.3.4.6. for other objective reasons.

7.3.4.7. other justified reasons (ex: placing and unsubscribing to more than three orders within 30 days).
7.3.5. The customer may cancel an order which was alreadyh made, when contacted, under art. 7.3.3.
7.3.6. If the client quits within the statutory period of withdrawal from the contract, an order made by credit card payment and the issuing bank has transferred client money paid on account CLISHOUSE LLC, this amount will be returned to the client within 14 days of the date on which the latter acknowledges this fact, IBAN indicated in writing by the Client.
7.3.7. If some products ordered by the customer made by Credit card payment is not available in stock, CLISHOUSE LLC will inform the customer of this fact and shall order a refund of the products in Customer's account within 48 hours the date on which CLISHOUSE acknowledges this fact.
7.3.8. The customer has the right to cancel or modify the contents of an order paid by any means of payment provided in this document within 24 hours of its placement. In this regard, the Customer shall submit a written request for cancellation to HISPANITAS team
7.3.9. If the customer has changed Order under Article 7.3.8 and its new value is less than the value of orders of products / services ordered initially, CLISHOUSE LLC will refund the money to the Client's account for the order amount representing the difference between the initial and new orders within 48 hours after the CLISHOUSE LLC acknowledges this fact. This provision applies only to orders paid with the card.
7.3.10. Details of delivery including but not limited to the time required delivery does not constitute a contractual obligation of the CLISHOUSE LLC, neither part has to ask for damages, if any part may be or is injured in any way from their violation.
7.3.11. If a customer changes their personal data, using the forms available on all existing orders in progress at the time, keeps data defined / accepted by the client before the time change, taking into consideration delivery and contact new data amended accordingly.
7.4. The phone order
7.4.1. The Client / Member can make telephone orders.
7.5. Contract and completion
7.5.1. CLISHOUSE LLC will include inside the package sent to the client all documents needed to certify the purchase of products / services.
7.5.2. CLISHOUSE LLC Client will facilitate the information according the command's completion stage .
7.5.3 The contract which contains added documents certifying the product delivery to the customer, becomes a honored contract.
7.6. Shipping and Payment
7.6.1. The delivery is made through a courier company, only in Romania.
7.6.2. Deliveries will be made, on average, 7 days after. If the product will be delivered to overcome the above-mentioned deadline, CLISHOUSE LLC will inform the customer by e-mail within 3 days of ordering, with the application of Art. 7.7.3, in which case the Customer may place a written order. If the payment has been made before the delivery date of the product / products ordered , the paid amount will be refunded in full accordance with the law within 14 days.
We strive to ship orders as soon as possible. Delivery is made via courier and once the order is shipped you will receive an automatic notification on your e-mail.
7.6.3 The fee for the collection and processing is the equivalent package in the below box:

The cost of transport is calculated according to Kg / package and will appear in your shopping cart before checkout.
For orders minimum of 300 LEI (including VAT) carriage is FREE.

Payment
Payment can be made in two ways:
1.
Cash-on-delivery. If you opted for the cash payment, you will pay to the agent courier who will deliver the product.
2.
Online by credit card (Visa/Mastercard/Maestro). We accept the following credit / debit: Visa, Visa Electron, MasterCard/Eurocard, Maestro, including virtual cards Visa or MasterCard.
Using the method of payment by bank card credit / debit card, your order will be processed immediately. If you choose the payment method "Online Bank Card" is required to complete a form with information about your card.
Payments with credit / debit cards emitted by Visa and MasterCard (Visa / Visa Electron and MasterCard / Maestro) is made through the "3-D Secure" developed by organizations that provide on-line the same level of security as those ATM or physical environment.
"3-D Secure" first guarantees that no information regarding your card is transferred or stored on our servers or servers payment processor, these data are entered directly into the Visa and MasterCard. Furthermore, "3-D Secure" is a system of identity authentication of cardholders in the electronic environment. Cardholder authentication process is based on the security code known only by the owner and takes place only on the Visa or MasterCard.
7.7. Quality and guarantees
7.7.1. Products sold by SC CLISHOUSE SRL, HISPANITAS BRAND benefits from the guarantee period specified in the warranty of the product.
Information regarding the terms and conditions of the guarantee CLISHOUSE SRL SC, and instructions for use of various types of products are delivered to the client as a document available on the WARRANTY section or as a leaflet inserted in each package.
No member / customer can request an extended warranty, in other terms and other conditions and / or a guarantee valid for a longer period than that provided in the documents mentioned in this article.
The warranty offered by SC CLISHOUSE SRL is issued in accordance with the law and based on obtaining supporting documents for quality / service life of the products traded, respectively, certificates of authenticity and / or compliance, obtained directly from the manufacturer and / or manufacturer's authorized distributor.
Each product marketed by SC CLISHOUSE SRL has a guarantee of compliance under Law 449/2003.
In accordance with art. 11 of Law 449/2003 each member or client may require in case of non compliance, repair, replacement or return the value of its product. Possible replacement of the product is in stock.
7.7.2. If SC CLISHOUSE SRL can not perform the contract because the product is not available, will inform the customer about the unavailability, after the SC CLISHOUSE SRL acknowledges the case. In the event that the product has already been paid by the Client, payment amounts paid will be reimbursed by SC CLISHOUSE SRL within maximum 14 days, unless the parties agree otherwise.
7.7.3. In the event of exceeding the deadline indicated in art. 7.6.2, SC CLISHOUSE SRL will inform the customer by e-mail / phone and will agree to extend this deadline by a period that shall not exceed the delivery time initially planned. If, in the new period mutually agreed, the product will be unavailable for delivery, the Customer may request the order cancellation. The Client has a term of 2 days from the date of issue of the notification of information to express their option on the product ordered. Lack of SC CLISHOUSE SRL receipt of a response from the Customer within the time specified, shall be deemed to accept its tacit extension of the delivery period.
In all cases where the customer opts in writing to cancel the order, if the product has already been paid, SC CLISHOUSE SRL will return the amounts paid in accordance with art. 7.6.2
7.7.4. The amounts paid will be refunded within 14 days to the extent that SC CLISHOUSE SRL holds all the necessary information in this regard, namely communication by the client in writing of IBAN which will complete the transfer of amounts paid.
7.8. Rerurning the products
SC CLISHOUSE LLC reserves the right not to fulfill orders made by persons who have paid more than 3 returns in a period of 3 months of the current year.
7.8.1. HISPANITAS online store customer may return products purchased through a contract, in the following situations:

7.8.1.1. Parcels shows severe damage;

7.8.1.2. The products were shipped / invoiced wrong;

7.8.1.3. Products manufacturing defects;

7.8.1.4 Sizes products have mistakenly ordered by the Client;

7.8.1.5 The consumer is entitled to notify in writing to waive the purchase without penalty and without giving any reason within 14 days of receiving the product."
Also, in accordance with art. 11 para. 1 of Ordinance 34/2014, the Client has the right to cancel the distance contract, within 14 working days from receipt of product / product without penalty and without giving any reason.
In this case, the direct cost of returning the goods will fall under the law in the Customer.

7.8.2. The Customer undertakes to notify the SC CLISHOUSE SRL, intention to return products purchased by any means of written communication (e-mail / fax / etc) within within 14 days after receiving the products and / or services.
7.8.3. SC CLISHOUSE customer who notified under Article 14 paragraph 1, has the responsibility to ensure that the products that made reference will be returned within 14 days, otherwise, SC CLISHOUSE SRL considering improper request / invalid and refuse to return.
7.8.4 SC CLISHOUSE may refuse returned products to its customers if the return falls into one of the cases provided here, without the latter to claim damages or compensation:

7.8.4.1. In case of replacing the purchased product with another or a different type, except stipulated in art. 7.8.1.4.

7.8.4.2. If the request for return for any of the situations provided in art. 7.8.1 is shipping date of notification of the return that exceeds the period of 14 days stipulated under Article 7.8.2, calculated from working day following the date of the contract honored.

7.8.4.3. If a product is returned with the motivation of the situations specified in art. 7.8.1, and the product is not returned in the same condition it was delivered (in original packaging with all labels intact and documents accompanying him).

7.8.4.4. For clarification, in the Customer notify intention of withdrawal of the contract according to art. 7.8.1, situation that attracts the obligation of the SC CLISHOUSE SRL to refund the amounts paid by the Client within de14 days, according to art. no. 13 para 1 of Ordinance 34/2014, the term mentioned will become due from the date the product was received by SC CLISHOUSE SRL and not from the date the Customer has sent to SC CLISHOUSE SRL intention to terminate.

7.8.4.5. According to O.G. 34/2014 art. 6 lit. i) SC CLISHOUSE SRL reserves the right not to accept the return of products which by their nature can not be returned. The footwear should not be used or dirty and returned to the original undamaged packaging (the boxes should be properly packed in order to avoid damage, being considered as part of the product). If the box shows signs of damage due to unpacking at the time of return, SC CLISHOUSE SRL reserves the right not to accept the RETURN.
7.8.5. If case of returning the amount of the product (less shipping charges), it will be done within 14 days of confirmation of the return.
The reimbursement will be made in lei by bank transfer to an account in lei indicated by you by email.
7.8.6. In case of replacing one product with a new size, according to 7.8.1.3, the replacement will be made in the conditions and limits of a normal order.
7.8.7. If the customer who returned a product in accordance with Article 7.8.1.3 and SC CLISHOUSE SRL lacks a suitable product for replacement, it will offer the client the equivalent product in accordance with 7.8.5.
7.8.8. The value of additional services including, but not limited to transport products, paid by the client, will not be reimbursed.
7.8.9. In all cases, the costs of return / redirection will be borne by the customer except as set out in paragraphs 7.8.1.1; 7.8.1.2; 7.8.1.3 and if the lack of conformity in accordance with 7.8.1., In which SC CLISHOUSE SRL for the costs of transport. Also, in case of a delivery / products unordered, according to the head. 7.3., the costs of return are borne SC CLISHOUSE SRL.
